What does legal-expenses cover pay for?

A client refuses to pay. A supplier delivers late. An employee challenges a dismissal. In each case, lawyer fees arrive fast. Legal-expenses cover pays those lawyer, expert and court costs. Depending on the options you choose, it supports you as claimant or defendant.

Belgian insurers often call it protection juridique. The principle stays the same: the insurer funds your defence within the policy limits.

A different logic from liability insurance

Professional liability insurance compensates a third party when you make a mistake. Legal-expenses cover, by contrast, pays your own costs to enforce your rights. Disputes the policy handles

Most policies span several branches of law. Each legal-expenses cover contract lists them in its general terms.

The wider the plan, the higher the limit per dispute. Price follows the same curve: a few hundred euros a year for a small firm, several thousand for broad legal-expenses cover. A company with staff almost always needs employment law protection.

Free choice of lawyer

The Belgian law of 4 April 2014 guarantees your free choice of lawyer. The insurer may suggest a partner lawyer, but it cannot impose one. This right applies once judicial or administrative proceedings start, and whenever a conflict of interest arises.

Watch the fee scales, though. Many policies cap what they pay per stage of proceedings. If your lawyer charges more, you pay the difference. So ask for these scales before you buy legal-expenses cover.

How to choose legal-expenses cover

A freelancer often takes the basic plan with a tax option. An SME with several staff tends to need the complete plan. Finally, construction or e-commerce firms add specific guarantees. Good legal-expenses cover fits your sector as well as your size.

Tax treatment of premiums

For a business, the premium counts as a deductible business expense. However, insurance premiums carry no VAT to recover. So budget for the full amount each year.

Making a claim, step by step

1Report the dispute to your insurer within the deadline in your policy, which tends to be short.
2The insurer reviews the file and your chances of success.
3It first seeks an amicable solution: a letter, a formal notice or mediation.
4If that fails, it funds the court proceedings.

A refusal must come with written reasons. Do you disagree with the insurer's view? The objectivity clause then lets you put the question to a lawyer of your choice. Example: an SME facing an unpaid invoice

Marc runs an IT maintenance SRL with four employees. A client owes him €18,000 and stops answering. Thanks to his legal-expenses cover, Marc opens a file in a day. The insurer first sends a formal notice through a lawyer. When payment still fails, it funds proceedings before the enterprise court. Marc keeps his usual lawyer, because the law gives him that choice.

Without insurance, Marc would have advanced the fees himself, with no certainty of recovering them.

Prevention still comes first
